By using Khata Tracker, it shall be deemed that the Users are expressly consenting to be bound by the terms and conditions described in this Privacy Policy. The User may revoke its consent for providing the sensitive information (as defined under Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011) by reaching out to Khata Tracker support in writing. Please note that Khata Tracker may discontinue providing services which depend on or require such sensitive information.

Khata Tracker may change and update this Privacy Policy from time to time. Such changes may be made without prior notice, but any changes will only apply to activities and information on a going-forward and not retroactive basis, unless specified otherwise. The Khata Tracker Products may contain links to other websites. Any personal information about the User collected when such User visits such websites is not governed by this Privacy Policy. The User is encouraged to exercise caution and review the privacy policies applicable to such websites before accessing them. The User acknowledges that Khata Tracker shall not be responsible for and has no control over the practices and content of any website accessed using the links contained on the Khata Tracker Products.

By agreeing to this Privacy Policy, a User (who is a natural Person) represents that the User is at least the age of majority i.e., 18 years, and is competent to contract. Additionally, where the User is registering on behalf of, and is the authorized representative of, a company, partnership or any other legal entity, such User has been duly authorized by such entity and is permitted under Applicable Laws to accept these Terms. In case the User is a natural Person who is not of the age of majority or is not competent to contract, the User may not use the Khata Tracker Products or provide any information to Khata Tracker.

Towards the provision of the Services and in cases where a User visits or uses the Khata Tracker Products, Khata Tracker shall collect the following information from a User ("User Information"):

User Information is used by Khata Tracker and its partners and service providers towards various business purposes which, amongst others, includes:

• To facilitate the User's requests and the Services
• To undertake research and analytics for offering or improving Services, Khata Tracker Products, their security and service quality
• To share with a User, updates on changes to Khata Tracker's services and their terms and conditions and provide details of similar products and services
• To aid strategic development, data collection and business analytics for Khata Tracker or its partners
• To take up or investigate any complaints/claims/disputes
• To respond to your queries or feedback submitted by the User
• For conducting audits and for record keeping purposes
• For complying with Applicable Laws including the directions of any Governmental Authorities
• For selective offers and promotions
• For providing a personalized experience and to enhance a User's experience in relation to the application or the website

User Information in the possession and control of Khata Tracker is stored in accordance with Applicable Laws, including without limitation, the Information Technology Act, 2000 and the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011. By using any of the Khata Tracker Products or Services, the User agrees and consents to the collection, storage and use of the User Information in the manner described in this Privacy Policy.

Khata Tracker may implement reasonable administrative, technical, and organizational measures intended to support business continuity and disaster recovery. However, the User acknowledges that no system can be guaranteed to be immune from interruption, failure, or loss, and data availability and restoration may be subject to technical limitations and factors outside Khata Tracker's reasonable control.

Accordingly, Khata Tracker shall not be responsible or liable for any loss, corruption, unavailability, or deletion of User data or information, whether arising from technical failures, synchronization issues, device-side conditions, user actions, or any other cause beyond Khata Tracker's reasonable control. Users are advised to maintain independent backups of their records using the export and download features provided within the Khata Tracker Products.

Khata Tracker implements reasonable technical and organizational measures to support data storage, synchronization, and availability. However, the User acknowledges that no digital system can guarantee absolute immunity from data loss, corruption, unavailability, or deletion due to technical failures, synchronization issues, device conditions, network connectivity, user actions, or other factors beyond Khata Tracker's reasonable control.

Accordingly, Khata Tracker shall not be liable for any loss, corruption, unavailability, or deletion of User data, whether arising from technical failures, system interruptions, device-side conditions, user actions, or any other cause. Users are strongly advised to maintain regular independent backups of critical business and financial information.

Khata Tracker provides a digital platform for recording and managing financial entries. While the Company implements reasonable technical and organizational measures to support data storage and synchronization, the User acknowledges that the availability, accuracy, and retention of records may depend on factors such as device conditions, network connectivity, synchronization status, and user actions.

Accordingly, the User agrees that Khata Tracker shall not be treated as the sole repository of the User's business or financial records, and the User is responsible for maintaining independent backups or copies of important information using the export or download features provided within the application (including PDF or Excel exports) or through any other recordkeeping method the User considers appropriate.

The User acknowledges the User Information and other data may be exported outside of India, processed and stored in a foreign country or countries where it may be accessed by other entities. User Information may also be transferred in accordance with Applicable Laws to Governmental Authorities, to affiliates of Khata Tracker and any potential buyers of the shares or assets of Khata Tracker. Khata Tracker may also distribute User Information (not being in the nature of sensitive personal information) with other third parties, analytics providers and other third parties for provision of services to Khata Tracker and/or the Users by such third parties.

Khata Tracker takes various reasonable steps and measures to protect the User Information provided by a User from misuse, loss, unauthorised access, modification or disclosure. Khata Tracker uses industry-standard secure server layers encryption and access control on its systems and other reasonable security practices and procedures.

While we strive to maintain the confidentiality of your information, no transmission over the internet can be guaranteed as completely secure. Therefore, by using Khata Tracker Products or Services, you acknowledge that we cannot be held responsible for any disclosure of your information resulting from transmission errors or unauthorized actions by third parties.

Khata Tracker may, at its discretion, retain any User Information for as long as a User is active on the Khata Tracker Products, as required under agreements with Khata Tracker or as required under Applicable Laws. Khata Tracker shall not be responsible for any destruction of any User Information after the closure or termination of a User's account with Khata Tracker.

A "cookie" is a packet of information stored on a browser by a server so it can be later read back. To improve the responsiveness of the site or application for the Users, Khata Tracker may use "cookies", or similar electronic tools to collect information. Note that information and data provided by a User may be collected in a "cookie" if the User has previously provided such information and data.

To facilitate the provision of services by Khata Tracker to the User, Khata Tracker may store information locally on the device of the User. The User consents to the local storage of information on the device of the User for the facilitation of the Services.

Where the Khata Tracker Products provide cloud synchronization, data will be available for restoration from Khata Tracker's servers only to the extent such data has been successfully synchronized and stored on the server through an active account session and internet connectivity. If the User uses the Khata Tracker Products in offline mode or where synchronization is interrupted, certain records may remain stored only on the User's device and may not be available for server-side restoration.

The availability of locally stored data may be affected by device-side conditions and actions, including device changes, logout, app uninstallation, clearing of application data, operating system or device-level issues, or other technical conditions outside Khata Tracker's reasonable control.

The Khata Tracker Products may provide features to help Users maintain independent backups of their records, including export or download options (such as PDF and Excel). Users are advised to periodically export and store backups for their own business continuity and recordkeeping purposes.

Khata Tracker reserves the right, at any time, to add to, change, update, or modify this Privacy Policy. The latest Privacy Policy will be available on this page.

In no event shall the total liability of Khata Tracker exceed the amount paid by the User for the Services in the preceding twelve (12) months.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.

In the event of any difference, dispute, claim, or disagreement arising out of or in connection with the use of the Khata Tracker application, its services, or these Terms ("Dispute"), the User and Khata Tracker shall first make reasonable efforts to resolve the Dispute amicably through mutual discussions within thirty (30) days from the date on which such Dispute is notified by either party.

If the Dispute is not resolved within the aforesaid period, the matter shall be subject to the exclusive jurisdiction of the competent courts located in Guntur, Andhra Pradesh, India.

Nothing contained in this clause shall prevent Khata Tracker from seeking appropriate legal or equitable remedies available under applicable law.
